Terms and Conditions

1.INTRODUCTION  

This document (together with any documents referred to in it) tells ‘you’ – the viewer or customer of the website – the terms and conditions (the ‘Conditions’) upon which we, Chamomile Baby (‘we’, ‘us’, ‘our’) sell and supply the goods (the ‘Goods’) listed on this website (the ‘Website’) to you.    

2.THE WEBSITE  

The website is owned and operated by Chamomile Baby whose place of business is 3, The Ashes, Great Lane, Bugbrooke, Northamptonshire NN7 3JP. Its content is protected by copyright (including design copyrights) and other intellectual property and similar proprietary rights. Copying or storing the contents of the Website for other than personal non-commercial use is expressly prohibited. At the moment it is only intended for customers resident in the UK. There is no requirement for you to register to view, browse, use or purchase from the website. We reserve the right, at any time, to change the domain address of the website and any of its contents – services, products, product descriptions, product specifications and prices and availability.  

By viewing, browsing, using or purchasing from the Chamomile Baby, you are agreeing to comply with and be bound by the conditions which, together with our Privacy Policy (‘Privacy’), govern our relationship with you regarding its use. You must not, under any circumstances, create a link to the website from another website, document or any other source without asking us first in a letter or email.

3.PURCHASES AND ORDERING

To be eligible to purchase the goods on the website and lawfully enter into and form contracts with us, you must be over 18, legally capable of entering into a binding contract and provide full details of a delivery and billing address in the UK. Before proceeding with and validating your order for any of the goods listed on the Chamomile Baby, you will be asked to tick the Conditions box to confirm that you have read and agree to the Conditions including Privacy. You will be unable to continue until you have done so.

It is your responsibility to ensure that any products, prices, services or information available through the website meet your specific requirements. All drawings, images, descriptive matter and specifications on the website are for the sole purpose of giving an approximate description for your general information and should be used only as a guide.      

4.PAYMENT

We accept all major debit cards, credit cards and PayPal. Unfortunately we do not accept Diners’ Club cards. 

Payment have to be debited and cleared from your account before your order can be acknowledged and progressed. Ownership of the Goods will pass to you on clearance of full payment.  

We are fully compliant with the Data Protection Act 1988 (as amended) and take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when you access or order from the website.

6.ORDERS

All orders are subject to acceptance and availability. Please make sure that all the details you have entered are correct and that, as required, you have provided us with a valid contact phone number and a valid, accessible e-mail address. Add hello@chamomilebaby.com to your e-mail contacts list to be certain we can communicate with you.  

As soon as an order is placed by you and paid for in full, it constitutes an offer to purchase the oods from us. An automated order acknowledgement, quoting an order reference number, will be sent to your e-mail address and forms a contract between you and us incorporating the Conditions. Please check the order acknowledgement carefully to ensure that all details regarding the goodsand their delivery address are correct. Please contact us immediately if you find any errors. 7.DESPATCH

We aim to despatch your order in one consignment and within 5 to 7 working days of receipt. We will advise you by e-mail when your order has been sent. By this, we specifically mean when the goods are in the hands of the post office or our carrier. Please note each gift box or gift box set will be treated as separate consignments.  Should there be a problem with the above timescale or with any aspect of order fulfilment, including stock availability, we will e-mail you as soon as possible to let you know and ask you what you wish us to do.

8.DELIVERY AND COST

The goods will be delivered to the address provided by you. This may, of course, be a different address to the one for billing, notably if you are sending a gift to someone. Please rest assured that if it is for a gift, going to another address we will not include the invoice in the parcel.

For deliveries, we use Royal Mail 1st Class service.

Orders sent will usually arrive the day after despatch. However, this is not guaranteed by Royal Mail. (Royal mail does advise that although they aim to deliver 93% of 1st Class mail the next working day after posting, they are unable to provide a guaranteed service)

Standard cost of delivery is £2.95. Free delivery on all orders of £25 or more.

Order by 16th December for delivery in time for Christmas.

9.CANCELLATIONS, RETURNS, EXCHANGE, DAMAGED OR FAULTY GOODS

Cancellations

If you wish to cancel your order please let us know through email within the first 48 hours of placing it. Our email address is: hello@chamomilebaby.com

Your notice of cancellation must quote your name, address, order reference number, description of goods and reason for cancellation.

Returns

If you wish to return the item/s to us, you have 28 days from receipt. On receiving your notice, we will confirm instructions as to the return of the goods. Unfortunately all returns are at your own cost and risk. Please note we will not refund any items that have been wore, washed and have had the labels or tag removed. Once we have received the item/s back and are happy that we are able to re-sell the goods, we will contact you for the refund. The refund will normally be for the cost to you of the goods, not for the original or return delivery costs. Please allowed 7-10 working days for the refund to go back onto your card.

Exchange

At Chamomile Baby, we want you to be completely happy with your purchase. If for any reason you change your mind, you may exchange your item/s within 28 days from receipt. Please clearly state in your e-mail or letter what you would like to exchange the item/s for with your address and a valid contact number. Postage is free for posting exchanging out to you, but unfortunately all returns for exchanges are at your own cost and risk. Our email address is: hello@chamomilebaby.com

Damaged or Faulty Goods

Should the goods delivered to you, have been damaged on delivery or are in a faulty condition, the same procedure as above will apply. Provided we are reasonably satisfied that the goods returned to us have not been worn, washed or cared for other than in accordance with the care instructions or the problem is not due to normal wear and tear, we will refund the full purchase price, including the cost of sending the goods back to us. Please send us written notice by e-mail or letter within 14 working days of you becoming aware of a problem. In the email or letter please quote your name, address, order reference number, description of the goods and the nature of the problem.

Alternatively, at your request, instead of a refund, we will replace the goods free of charge with the same or a similar product of the same total value subject to availability. We aim to despatch such replacements within 5 to 7 working days of receipt of your letter or e-mailed instructions.  

Please note that in all of the above we are fully compliant with the Consumer Protection (Distance Selling Regulations) 2000 and that your statutory rights are not affected.

10.CARE INSTRUCTIONS

Failure to comply with care instructions may invalidate any claim you may have to a refund for damaged and faulty goods. Refer to Size & Care Guides for further details.

11.GENERAL

Chamomile Baby shall have no liability for delays or failure in delivery or performance of our obligations to you resulting from events or circumstances outside our control (‘Force Majeure’) which, without limitation, include Acts of God, strikes, lock-outs, accidents, war, fire, adverse weather, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of materials, and we shall be entitled to a reasonable extension of our obligations in these circumstances.

Contracts between Chamomile Baby and you will be governed by English Law and all disputes will be submitted to the jurisdiction of the English Courts. If any provision of the Conditions shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of the Conditions and the remainder of the affected provision shall be unaffected.
